To the maximum extent permitted by law, MakeMoneyMarkets shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of this platform, including but not limited to trading losses, lost profits, or data loss. We reference third-party services including TradingView, Tradovate, NinjaTrader, and various prop firms. We are not affiliated with, endorsed by, or responsible for any third-party service. Their use is governed by their own terms.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or your use of the Platform shall be brought exclusively in the state or federal courts located in New York County, New York.
Binding Arbitration. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall take place in New York, New York. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver. You agree that any arbitration or proceeding shall be limited to the dispute between us individually. To the fullest extent permitted by law: (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any dispute to be arbitrated on a class-action basis; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
Small Claims Exception. Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
This Platform is operated from the United States and is subject to United States law. If you access this Platform from outside the United States, you do so at your own initiative and are solely responsible for compliance with the laws of your jurisdiction. Nothing on this Platform constitutes an offer, solicitation, or recommendation in any jurisdiction where such activity would be unlawful.
We make no representation that the Platform, its content, or the trading strategies discussed are appropriate or available for use in all locations. The educational content references United States markets, regulations, tax laws, and broker-dealers — these may not apply to your jurisdiction. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and MakeMoneyMarkets regarding the use of the Platform, superseding any prior agreements.
We may update these terms from time to time. We will notify subscribers of material changes via email. Continued use of the platform after changes constitutes acceptance.
